A Kazakhstani abroad reached out to the government to advocate for changes to the car insurance law.

The Constitutional Court examined a petition from a Kazakh citizen residing abroad. The case arose due to a gap in the law regarding mandatory civil liability insurance for vehicle owners, as reported by Orda.kz.

“The vehicle is registered in another country, and the basis for the refusal was that the laws did not recognize such a vehicle as an international means of transport, even though it was used only temporarily,”
clarifies the Constitutional Court.

The court reminded that according to the international Convention on Road Traffic, signed by Kazakhstan, a vehicle is considered international if it belongs to a person who resides permanently outside the country and is imported temporarily. The nationality of the owner does not play a role in this matter.

“The current laws are correct when it comes to vehicles temporarily imported by foreigners or stateless individuals. However, they violate the Constitution in the case of Kazakhstani citizens living abroad whose vehicles are used temporarily within the country,”
determined the highest judicial authority.

The government is now recommended to review the legislation to prevent such situations from occurring in the future.
