According to the lawsuit provided to the Orda.kz editorial team by lawyer Murat Adam, his client Alimbayev has been working in the structures of the Ministry of Foreign Affairs since 1997. From October 2020 until July 31, 2023, he served as an advisor at the Embassy of Kazakhstan in Thailand. A month after leaving his position, he returned to Kazakhstan, but has yet to receive a new appointment. As a result, the diplomat decided to file a lawsuit.
“According to paragraph 4 of Article 9 of the Law of the Republic of Kazakhstan 'On the Diplomatic Service in the Republic of Kazakhstan', personnel of the diplomatic service returning to Kazakhstan after working abroad are appointed to a position no lower than the one they held in the Ministry of Foreign Affairs, provided they have not been subjected to disciplinary action,” the lawsuit states.
The Ministry of Foreign Affairs refuses to appoint him to a new position because in October 2022, Nurbolat Alimbayev received a formal reprimand, which led to the decision not to include him in the agency's personnel reserve.
The former embassy advisor believes that the disciplinary action had expired by the time he returned to Kazakhstan. Alimbayev argues this based on the rules for imposing sanctions on civil servants, which state that in the absence of any violations, a diplomat is considered "clean".
“The disciplinary action in the form of a formal reprimand imposed on the plaintiff on October 20, 2022, expired on April 20, 2023,” the plaintiff clarifies.
Now, Nurbolat Alimbayev demands to be appointed to a position no lower than the one he held until July 31, 2023, and to have the defendant, namely the Ministry of Foreign Affairs and Murat Nurtleu, cover the legal costs.
