In the Abai region, a court has reinstated an orphan in the housing queue who was previously registered together with his twin brother under a single number, reports Kazpravda.kz citing the Supreme Court of the Republic of Kazakhstan.
From 2001 to 2011, both brothers were raised and educated in a boarding school for orphans. Local authorities provided a one-bedroom apartment to only one of them, while the other was classified as a family member, which deprived him of the opportunity to receive housing from the state housing fund.
The Housing Relations Department and the Housing Inspection of the city denied the second brother's request to restore his rights in the housing queue. In response to the denial, the plaintiff appealed to the regional Smas in Abai for the restoration of his violated rights.
The court, upon reviewing the case, emphasized that every orphan has the right to receive housing from the state housing fund, regardless of whether they were listed as a family member or not. The court rejected the argument that the plaintiff supposedly has housing, as no rental agreement was made with him, and the apartment was issued to his brother.
The court granted the claim and ordered the Housing Relations Department and the Housing Inspection of Semey to reinstate the registration of orphans without parental care for housing since June 6, 2008.
The court also warned that if the decision is not executed within a month from the date it comes into legal force, measures of procedural compulsion will be applied, as stated by the Supreme Court of the Republic of Kazakhstan.
