The Constitutional Court has received a request to examine the compliance of part 4-1 of article 597 of the Code of Administrative Offenses with the Constitution. This provision establishes liability for evading payment for parking a vehicle in areas equipped with specially certified devices, taking into account the duration of parking.
“The Constitutional Court noted the existence of material norms in the law 'On Road Traffic,' based on which the code includes the norm on administrative liability. The citizen did not challenge the constitutionality of these legal norms. Furthermore, the citizen's request pertains to a number of factual circumstances related to the case of the administrative violation, and their verification should be carried out by other authorized bodies and the court,” the statement said.
It is emphasized that the Constitutional Court exclusively addresses legal issues and does not evaluate the factual circumstances that led to the request.
“Thus, there are neither subjects nor permissible conditions for checking compliance with the Constitution,” the court explained.
